When selling an AL to a new holder, does it have to be re-registered?

Imagine a Local Accommodation with an LA registration number already assigned, that same establishment is sold and the new owner intends to continue with the LA activity.
Must there be a new registration and a new prior communication with a deadline?

Do not. The owner of the farm may change, provided that the Accommodation is not in a containment area, in the form of an apartment. 

To change the ownership of a registration of a Local Accommodation establishment, the Entrepreneur's Desk must be used, accessible through the EPortugal Portal and choose the option data change or in person at the competent city hall, by the new explorer, attaching the required documentation.

 

In the course of changing data online, the form will ask if you want to change ownership.

Like this, it is not necessary to proceed with a new prior communication with deadline for registering the Local Accommodation, since it is already registered, it already has a national registration number, and what you want is just to change the holding of the holding.

 

The new owner of the holding must be able to perform the activity of providing accommodation services, that is, having one of the CAE (55201 or 55204) that allow you that activity.

If you want to own the holding as a natural person will have to submit, through the Entrepreneur's Desk, the corresponding declaration of commencement or change of activity presented to the Tax and Customs Authority.
If you want to own the holding as a legal person you just have to indicate the access code to permanent certificate of the company where one of the CAE required.

 

Similarly, the new holding of the holding you will have to submit at the Entrepreneur's Desk a simple copy of the urban building book the property in question, if you are the owner of the property, or simple copy of the lease or other title that legitimizes you to exercise the activity and, if the lease or other does not contain prior authorization for the provision of accommodation services, you must also submit a simple copy of the document containing such authorization.

 

If you intend to use the assistance services mediated by the competent City Council, to change the data of the Local Accommodation you must go to the public service, paying for the effect € 15.00.

Article 6
Prior notification with deadline

3 - The owner of the establishment's operation is obliged to keep all communicated data up-to-date, and must carry out this update at the Balcão Único Eletrônico within a maximum period of 10 days after the occurrence of any change.
4 - The cessation of the operation of the local accommodation establishment is communicated through the Balcão Único Eletrônico within a maximum period of 10 days after its occurrence.
5 - The owner of the operation of the local accommodation establishment communicates to the electronic reservation platforms, within a maximum period of 10 days, the cancellation of registration and / or the temporary ban on the operation of local accommodation establishments.

 

Article 7
Opening title to the public
2 - The registration number of the local accommodation establishment, in the forms of "housing" and "apartment", located in containment areas under the terms of article 15-A is personal and non-transferable even if held or owned by a legal person .
3 - Under the terms of the previous paragraph, the title of opening to the public expires in the event of:

a) Transfer of ownership of the registration, cessation of exploration, lease or other form of alteration of ownership of the holding;
b) Transfer of the share capital of the registered legal entity, accumulated or not, in a percentage greater than 50 %.
4 - The previous number does not apply in case of succession (death).

 

Law no. 62/2018 of 22 August - Republication of Decree - Law no. 128/2014, of 29 August, which approves the legal regime for the operation of local accommodation establishments.
